This action was brought by the appellee under Section 8(e) of the Selective Training and Service Act of 1940, 54 Stat. 890, as amended, 56 Stat. 724, 50 U.S.C.Appendix, § 308(e).
The complaint alleged that, immediately prior to his induction into the army of the United States, the appellee held a permanent position as truck driver with the appellant;
