PER CURIAM.

This appeal is from an order denying a petition for a writ of habeas corpus. Appellant shot and killed a man named Hunter. His conviction of murder in the first degree was affirmed by this court. Griffin v. United States, ___ U.S.App.D.C. ___, 164 F.2d 903, certiorari denied March 15, 1948, 333 U.S. 857, 68 S.Ct. 727. Respondent has moved to dismiss the present appeal as frivolous.
