This suit is brought by the plaintiff, under the provisions of 28 U.S.C.A. §§ 1336, 1398, 2284, 2321-2325, 49 U.S.C.A. § 17(9), to set aside an order of the Interstate Commerce Commission entered on September 5, 1947. The contested order involves dining car service afforded Negro passengers on the Southern Railway. This is the second time that the present plaintiff has litigated the question before the Commission and this Court...
