Plaintiff is a family partnership consisting of husband, wife and son. Original defendant was Missouri Leather Company, Inc. When this case was called for trial the parties named announced ready. A colloquy between counsel followed resulting in agreement that B. L. Marder Company was the real party in interest and defending the action. Plaintiff then amended its complaint naming B. L. Marder Company as defendant and dismissed as to Missouri...
