This is an action for a declaratory judgment under Section 400, Title 28 U.S.C.A. The plaintiff says he was injured by reason of the negligence of the personal defendant Haden R. Frisbie. It is alleged, however, that the said Frisbie contends that he was operating a motor vehicle which was the property of the Missouri State Guard and that at the time he too was an enlisted man of the Reserve Military Force and that by reason of such relationship...
