The respondent, Magee, appeals from an order in bankruptcy which directed him to turn back to the petitioner — a trustee in bankruptcy of the Harlem Garment Center, Inc. — $5000 alleged to be assets of the bankrupt. Upon the trustee's petition the referee ordered Magee to show cause why he should not turn over the money, Magee answered, the case came on for trial and considerable testimony was taken.
