The petition of James Elwood MacKay for naturalization is denied. It is the holding of the Court that the petitioner is not entitled to be admitted to citizenship:

First, because he comes within the purview of Section 305 of the Nationality Act of 1940, 8 U.S.C.A. § 705, which in pertinent part provides that, "No person shall hereafter be naturalized as a citizen of the United States...
