SWAN, Circuit Judge.

In 1944 the relator was convicted of violating the Selective Training and Service Act, 50 U.S.C.A.Appendix, § 301 et seq., by failing to report for induction; he was sentenced to imprisonment for three years. The judgment was affirmed by this court, 2 Cir., 146 F.2d 874, on the basis of the Falbo case, 320 U.S. 549
