HARLAN, Judge:

This case involves a deficiency in an estate tax in the estate of Wilbur L. Jack, deceased, originally in the amount of $13,931.61. This amount included an estate tax on a charitable bequest and on an amount paid by petitioner for attorneys fees, the deduction of which the Commissioner admitted error in his refusal to allow this deduction of attorneys fees.
