This is an action under the Federal Declaratory Judgment Act, 28 U.S.C.A. § 400, presenting for determination only the question as to the coverage of an automobile liability insurance policy. By agreement of the parties the case is submitted to the Court for a declaratory judgment upon the facts set out in the pleadings which are, in substance, as follows:
