Plaintiff's claim arises out of the sale and delivery by it to defendant of certain quantities of coal in 1939, for which it contends it has not been paid in full. By virtue of a stiplation entered into between the parties subsequent to the filing of plaintiff's petition it is agreed that judgment in the amount of $22,000 may be entered in favor of plaintiff, in full settlement of all matters involved in this case, provided plaintiff's claim is not barred...
