I think the plaintiff is entitled to the benefits of the Fair Labor Standards Act of 1938, 29 U.S.C.A. § 201 et seq. The period involved is from November 15, 1943 to and including March 17, 1945. During this period the defendant was engaged in New York City exclusively in the production of binoculars for the United States Navy under a cost plus a fixed fee contract, and it is conceded by the defendant that upon the completion of the binoculars...
