The appellant, a registrant under the Selective Training and Service Act of 1940, was, by an indictment in two counts, charged with two separate violations of Section 11 of the Act, 54 Stat. 894, 50 U.S. C.A.Appendix, § 311. He entered a plea of not guilty and was tried. The jury found him guilty of the offense charged in the first count and not guilty of the offense charged in the second count.
