This is a motion made on behalf of defendant for an order modifying a sentence imposed by this court in 1939, nunc pro tunc, as of the date of the imposition of said sentence, recommending withholding and waiving of an order of deportation of defendant, pursuant to Title 8, Section 155 (a) of the United States Code, annotated. The motion is opposed by the United States Attorney.
