The complainant instituted this action against the defendant to enjoin and restrain him, his servants, agents and employees, from using the name "Acme Chemical Company" or any similar name incorporating the name "Acme" in the conduct of his business. In addition thereto, the complainant seeks therefor damages from the defendant, and, in addition, to have the defendant account for and pay over to the plaintiff all profits realized by the defendant...
