This is a suit for annulment on two grounds: (1) lack of contractual intentions, and (2) fraud in misrepresenting age. Since this marriage was performed in Maryland, it follows that Maryland law is controlling.

This being so, at the outset we are confronted with the Maryland ruling (Brown v. Scott, 140 Md. 258, 117 A. 114, 22 A.L.R. 810) that in alleging fraud in the procurement of a marriage, application for relief should be made...
