Petitioner filed his amended petition for a declaratory judgment, alleging that he is a native born citizen of the United States and a resident of Helena, Montana; that the United States, acting under the Selective Training and Service Act of 1940, 50 U.S.C.A. Appendix, § 301 et seq., drafted him into the military service of the country on the 19th day of October, 1942; that he remained in such service until the 6th day of August, 1945...
