This appeal is from a judgment of conviction upon an indictment charging appellant with breaking the seal on a railroad car containing an interstate shipment of goods and with the theft of a part of the contents of the car in violation of 18 U.S. C.A. § 409. For reversal the appellant contends that the Federal court was without jurisdiction of the action, because the evidence adduced at the trial shows that the acts with which appellant...
