The above-entitled cause came on for trial before the Court without a jury.

The facts necessary to an understanding of the case appear to be the following: Philomena Flannery married one Bernard Flannery, a veteran of the first World War, in 1923. He died in 1924 and, as his wife, she drew a pension of $30 per month until February 28, 1937, when the payments were increased to $37.50 per month, and which payments continued until June...
