The petition filed in the state court for death damages was in two counts. The first count1 was based on negligence of the defendant in failing to furnish safe tools and appliances, to-wit, suitable and safe priming cans to be used in the priming with gasoline of internal combustion engines. Count Two2 charged negligence in not providing a safe can and in not promulgating safe rules...
