MELLOTT, Judge:

The Commissioner determined the following deficiencies in income tax:

  Peter Vamvaks ..........    $14,451.87    $1,438.27
  Constantine Limmiatis...     13,883.41     1,059.83

The deficiencies for 1941 are not contested. Each petitioner claims that the deficiency for 1940 is erroneous and that he is entitled to a refund...
