The court, after hearing and consideration, makes the following Findings of Fact and Conclusions of Law:

Findings of Fact

1. On and prior to February 27, 1943, Charles Zubik, the plaintiff, was the sole owner of a wharf boat, barge or screen boat known as the "Mariner," Official No. 175020. On said date said "Mariner" was requisitioned by the United States of America.
