In this case the defendants were indicted for (1) having in possession and control a 75-gallon unregistered distilling apparatus; (2) carrying on the business of a distiller in spirits with intent to defraud the United States of the tax thereon and (3) making and fermenting mash, to wit, 240 gallons of fruit mash, fit for distillation for the production of spirits on premises which were not a distillery...
