The plaintiff filed its income and excess profits tax return for the year 1937, showing an income tax due of $41,238.50, which was paid in five payments, the last payment having been made about December 14, 1938. After an examination of the return, there was issued by the Commissioner of Internal Revenue a certificate of overassessment and a refund of taxes, including interest, was made in the amount of $1,148.61, which overassessment and refund...
