This action was brought against the defendant, as trustee of the Chicago and North Western Railway Company, to recover damages for the wrongful death of plaintiff's intestate, Private Victor Jacobowitz, a member of the military police of the United States Army, who was struck and killed by one of defendant's trains while on duty guarding a railroad bridge across the Mississippi River between Illinois and Iowa.
