The petitioner has filed a request for a writ of habeas corpus averring that he is being detained illegally by the Warden of the Illinois State Penitentiary at Stateville, Joliet, Illinois.

The writ subsequently issued, counsel was appointed for petitioner and upon hearings duly had in open court the following facts were stipulated and agreed to by both sides:
