The first point, it seems to me, to require consideration by the Court is that one made by respondents (through Mr. Griffin) that the Acting Secretary of War was not shown to have authority to initiate these proceedings in the manner that has been done. I am, however, of the opinion that the statutes cited and relied upon by the Government do authorize the Acting Secretary to institute these proceedings and that this act of the Acting Secretary...
