From the stipulation of facts entered into by counsel in this case it appears that on October 1, 1930, one Pearlman and his wife executed a trust agreement in which they agreed to transfer certain of their assets to the appellant Hardt, as trustee, for prompt liquidation and equal and ratable distribution among their creditors.
