The Administrator of the Wage and Hour Division, United States Department of Labor, instituted this civil action under section 17 of the Fair Labor Standards Act of 1938, 29 U.S.C.A. § 217. It sought to restrain appellee from violating the Act. The District Court made a special finding of facts, stated its conclusions of law thereon, rendered its judgment favorable to appellee and dismissed the complaint on the merits.
