The question before the Court is the admissibility of testimony in the nature of a confession which the Government proposes to offer, and to which objection is made upon the basis of a recent decision of the Supreme Court in the case of McNabb v. United States, 318 U.S. 332, 63 S.Ct. 608, 87 L.Ed. ___.

As suggested in that decision, I have, in the absence of the Jury, heard the preliminary testimony...
