Turner, instituted this action under the Federal Declaratory Judgment Statute, Judicial Code, § 274d, 28 U.S.C.A. § 400, wherein she sought to obtain a declaratory judgment or decree to the effect that the policy, usage and custom of the defendants in adopting, enforcing or maintaining a salary schedule fixing salaries of the plaintiff and other negro teachers at a rate lower than that paid to white teachers...
