The appellant was tried in the District Court for the Southern District of New York on an indictment in one count charging him, in violation of 18 U.S.C.A. § 88, with conspiring with Anthony Barracato, two fictitious persons called John Doe and Richard Doe, as to which there was a severance before trial, and divers unknown persons to endeavor to obstruct or impede the due administration of justice.
