This is an appeal by plaintiff from an unfavorable judgment, entered September 29, 1942, in an action upon a contract, executed April 20, 1937, signed by Allen J. Patch, Engineer (plaintiff) and Perry G. Stahly, Trustee (defendant). The suit was against Stahly individually and the main defense, sustained by the lower court, is that he was not liable in such capacity.
