The appellant, Max Caldwell, and his codefendant, Michael Savachka, were convicted under both the first and second counts of an indictment charging conspiracy to violate, and violation of, the Selective Training and Service Act of 1940.1 Caldwell was sentenced to serve a term of two years and pay a fine of two thousand dollars on the first count, and two years on the second count, to run concurrently with the sentence...
