1. This is an action brought under the Fair Labor Standards Act of 1938, 29 U. S.C.A. §§ 201-219.

Plaintiff was employed by the defendant corporation in Detroit, Michigan, from prior to the effective date of the Act, October 24, 1938, until July 7, 1942, when he voluntarily left the defendant's employment.
