The bankrupt Tuccillo while driving his automobile on Avenue N in Brooklyn on November 27, 1940, struck the automobile of Solomon Greenfield as it was crossing Ocean Avenue at the intersection of Avenue N. Greenfield's car was thrown into the air, as a result of which his four year old son Jerome Henry Greenfield was thrown out and instantly killed.
