Beginning as two suits, one by appellant, Standard Oil Company of Kansas, to compel, the other by appellee to restrain by injunction, the delivery of tires imported from Cuba, the two suits were, before judgment, consolidated into one. In appellant's suit, the claim was that it, as importer, had complied with all customs regulations and requirements, and it became and was the mandatory duty of the collector to deliver the tires to it.
