Defendant is charged with violating 50 U.S.C.A. Appendix, § 311, by knowingly refusing, failing and neglecting to submit himself to induction into the armed forces of the United States on December 10, A.D., 1941. A jury was waived and after trial before the Court, he was found guilty on January 17, 1942. From then until January 22, 1942, the Court had under consideration the matter of sentence.
