Plaintiff sues to recover taxes, together with penalties and interest, paid by plaintiff on the initiation fees of its members from 1933 when plaintiff club was organized, through May 1936. The tax was not collected by plaintiff from its members when the initiation fees were paid, and later when the Collector made demand for the tax the plaintiff elected to pay it itself rather than to allow it to be assessed against its members.
