Plaintiff brings this suit for an accounting of certain transactions of the defendants in the stock of Fidelio Brewery, Inc., which, it is alleged, was to be dealt in for the joint benefit of Norman S. Goldberger, her testator, and the defendants. The amended complaint sets out two causes of action, the first upon an alleged oral agreement claimed to have been entered into on or shortly prior to June 8, 1933, between the defendant corporation...
