Mulligan, the present debtor, is the same person who prosecuted the proceeding in Case No. 3332 in this court, No. 12,187, in the United States Circuit Court of Appeals, Eighth Circuit, in which the opinion of the Circuit Court was filed on April 9, 1942. Mulligan v. Federal Land Bank of Omaha, 129 F.2d 438
