The jury having failed to agree upon a verdict at a former trial of this case, the District Court, upon motion, entered judgment for the defendant on the ground that the proofs were legally insufficient to justify a verdict in the plaintiff's favor. The claim sued for grows out of a life insurance policy issued by the defendant and is for the double indemnity provided for by the policy in case the insured's death resulted from bodily injuries...
