The appellant, hereinafter referred to as the defendant, and Stephen T. Povich were jointly indicted for a robbery charged to have been committed upon Howard Edwards in the District of Columbia on April 10, 1941. The defendant was separately tried, found guilty by a jury, and sentenced to imprisonment for one and one-half to four and one-half years in the penitentiary.
