This appeal is from a judgment entered upon the verdict of a jury finding the appellant (hereinafter referred to as defendant) guilty under five counts of an indictment.1 Two of these counts (Fifth and Sixth) charged violations of § 17(a) (1) of the Securities Act of 1933, c. 38, Title I, 48 Stat. 84, 15 U.S.C.A. § 77q(a) (1),2 and the other three (Eighth, Ninth and Tenth)...
