Claiming that appellees had violated the Robinson-Patman Act, Sec. 13, Title 15, U.S.C.A. by destroying appellant's competition in the sale of building materials, General Shale Products Corporation brought suit for triple damages. After a pre-trial hearing, the district court entered an order dismissing the case, from which appeal is taken.
