These consolidated actions were brought by plaintiff to recover deficiency assessments levied against it for the calendar years 1936 to 1939 inclusive. Claims for refunds were duly filed and disallowed by the Commissioner. The facts were stipulated. The dispute involves claimed deductions for depletion of the plaintiff's mining property.
