The Government has indicted Offutt, a lawyer, and Sopourn, a registrant under the Selective Training and Service Act of 1940, for conspiracy. The offenses against the United States which are said to be the object of the conspiracy were violations by Sopourn of the Selective Service Act.1 There is a demurrer to the indictment which was sustained, without opinion, by the trial court.
