This is an appeal from a judgment denying a petition for a writ of habeas corpus.

Hastings, hereinafter referred to as the petitioner, was charged by an indictment returned December 12, 1939, in the District Court of the United States for the District of Nebraska, with a violation of 18 U.S.C.
