This is an action under the Fair Labor Standards Act of 1938, 29 U.S.C.A. § 201 et seq. Section 216 of the Act provides that an employer who violates any of the terms of the Act shall be liable to the employee or employees in the amount of the unpaid wages or overtime plus an additional amount as liquidated damages.
