This is a suit brought in the name of the Brier Hill Steel Company by John Tod, its surviving manager and trustee.

On March 1, 1923 plaintiff sold and transferred all of its assets, except the legal title to the claim here involved, to the Youngstown Sheet & Tube Company, and in 1926 the plaintiff was dissolved; but under the laws of the State of Ohio, John Tod, its surviving manager and trustee, is authorized to bring this suit in its...
